The issue
Our client, was facing significant challenges in securing agreement on its extension of time (EOT) entitlement and associated prolongation costs for a project in Cockfosters, London. An earlier EOT application had been rejected by the Employer, and our client required a fully reworked submission that would not only present a clear entitlement case but also quantify the delays for inclusion in a Target Cost Adjustment claim.
We were appointed to produce a comprehensive EOT application and loss and expense claim, integrating an expert delay analysis from a third-party planning consultant into our report. The aim was to secure approval from the Employer or to strengthen our clients position in potential negotiations.
Our approach
One of the main challenges was that several key project personnel had left, taking with them valuable first-hand knowledge of the delays. Additionally, the volume of information and project correspondence to be reviewed was substantial.
To overcome this, we held multiple structured workshops with our clients commercial and operational teams, supplemented by direct liaison with their commercial director, to reconstruct the sequence of events and clarify delay causes. We also gained access to the project’s management platform (CEMAR), which provided a detailed and complete record of EOT notices, compensation events, and project manager instructions.
Our client had already engaged a delay analyst to produce an expert delay report, which we incorporated into our submission. We ensured that the delay analysis was aligned with our narrative and cost build-up, providing a consistent and coherent case for entitlement.
The loss and expense valuation was built from the bottom up, using actual project data where available to substantiate the prolongation costs. The claim linked the additional time entitlement to its cost impact, clearly presenting the cause-and-effect relationship required for contractual compliance.
The outcome
We delivered a fully integrated EOT application and loss and expense claim that combined robust delay analysis with detailed cost substantiation. The submission has been provided to our client’s client and is currently under review.
The service we provided has equipped our client with a clear, evidence-based claim that strengthens its negotiating position and provides a ready-to-use case should the matter proceed to formal dispute resolution.
